Legal Question in Family Law in Connecticut

Divorce of a foreign marriage

I was married in Egypt - 8 years ago.

I am an American citizen. My husband became an American citizen.

My husband has left America.

Can I file for divorce in Connecticut - and can I base this on desertion.

I thank you in advance for any advice you could give.

Connecticut is a no fault state. This means you do not need to show desertion or any other grounds to obtain a divorce. However, you must show that the marriage is "irretrievably broken."

Even though you were married in Egypt, you can file in Connecticut so long as you have lived here for at least 12 months preceding the date you obtain the judgment of divorce.

If you have lived in Connecticut for 1 year, you can get a divorce here, regardless of where your husband is. You would get it on the basis of irretreivable breakdown. It takes 4-5 months, has out of pocket expenses of about $300 (plus the costs of notifying him of the lawsuit, by registered mail or by newspaper publication wherever he now lives) and lawyer's fees (if you use us) of $1800.
