I am going through a divorce, isn't it true i am legally entitled to half of my husband's tax return? not just what little he wants to give me?

The tax refund is a marital asset, but neither of you has a right to a set percent of the refund. If you filed jointly, the check should be made out to both of you. The tax refund will be taken into consideration in the final settlement of your property.
