Domestic Violence

I have been seperated from my abusive husband for 6 months. The DA has convicted him of misdemeanor spousal abuse and child endangerment. I have sole physical custody and joint legal custody of our children. I am currently being stalked regardless of restraining orders and no-conact orders. My husband has visitation. If I move all of us out of the state but still comply with the visitation schedule, am kidnapping the children or in contempt of court? I do not intend to block him from seeing the kids. I just want to live long enough to see them grow up. He has threatened to kill me (documented with police reports).

Does your child custody order have a prohibition against moving out of the state? If it does you will need court permission, which will most probably be granted. It would be worth having a family law attorney review the order. Good Luck. Pat McCrary
