Legal Question in Family Law in Connecticut

egg donation

We are trying to have a child through egg donation. I am wondering what would happen if to the chlid we ever got divorced Would I be considered the legal mother since I carried the child and gave birth to it? Just wondering how a custody case would be since the child is not mine biologically but would be my husbands bio child.

Re: egg donation

If you are not the biological mother, that would mean the egg donor is the biological mother. Since the egg donor is simply selling her egg and not a child, it would seem to me that you are the legal biological birth mother of the child. Therefore, your rights would be the same as any other birth mother who brought a child to full term. There should be no disparity in your rights with your husband simply because he offered up his own sperm. For further information or questions, contact me 203.380.8189 - Attorney Max L. Rosenberg
