emergency temp custody

I have my 7 yr old niece for the summer, her parents were staying with my father but were served a restraining order today. They have no where to stay and the mother just quit her job and the father is monitored on an ankle bracelet. the mother has been evicted twice in the past 2 yrs and was arrested for home invasion last year. she served time in prison. They have let me have the child for the summer and she is in camp and very stable. Can I obtain temp emergency custody and how. They are both in the legal system and are dealing drugs. please help me.

It is not clear from your question who applied and served them with a restraining order. It's also not clear what the restraining order says and from whom are they restrained.

Nevertheless,you should make application to the family court in your district for temporary emergency custody. They will have to be served the papers by a marshal and will have an opportunity to object. If they will just agree to it then you can go to court on the court date you are given and submit a written agreement that you all have signed giving you temporary custody. They will need to be in court also.

Otherwise, if they don't agree, you will need to have a hearing at some point.
