Equitable Distribution

I have an attorney but looking for a 2nd oppionion. I have been married for 2.5 years from 1999 to 2002, when I filed for divorce.My sole name is on the mortgage for a condo I purchased during our marriage for her parents to reside in and pay us rent. I used money from my 401K as a downpayment.No lease was ever signed between us. When my exwife left me, she resided in that condo temporarily. My exwife has recently moved to Florida, and is in comptempt of temporary orders for vacating the premisis along with her family. Does she have any rights to that property as part of equitable distribution, even though the length of our marriage was short?

Probably not. If a lot of equity built up during the marriage, she might have a shot at 1/2 AFTER you are paid back your downpayment (I'm assuming the 401k existed prior to the marriage). Especially if she's in violation of orders relating to the condo, I wouldn't worry about her getting any part of it.
