Legal Question in Family Law in Connecticut
My ex-wife took pills and was drinking last night. She was telling our 13 year old daughter that she wanted to end her life and that she wanted me to take good care of her. She was totally out of her mind and my daughter called 911. I had to go pick up my 13 year old daughter from the house at 1 am because an ambulance took my ex to the hospital. A week earlier her live in boyfriend attemped suicede. My daughter is here with me at my house and her mother has been released from the hospital. I'm afraid for my daughters safety and don't want her to go back to her mom's house. Can I legaly keep her and not let her go back to an unstable house. I feel that it's a bad enviroment for a 13 year old girl to be in.

Yes, you can keep your daughter with you. However, you should file an emergency motion for change of custody (in your divorce case) and get into court as soon as you can. If the court will not hear it on an emergency basis, then you should just keep your daughter until the motion comes up on the calendar. Your zip code appears to be Enfield so this sounds like a Hartford case. I don't know how long motions take to come up on a calendar in Hartford, but in New Haven, Middletown and Milford it's usually about 2 weeks. I think considering the circumstances, a court will hear this immediately.
Attorney subloie is correct you need to file an immediate injuction for custody and get it on the calendar as an emergency. Keep your child with you and feel free to call us for more information. 203.870.6700
