Recently my child's mothers boyfriend was arrested. This was for a vandalism charge. This is the third time where he has been arrested this year. The first time was for a domestic dispute. I don't see them breaking up, they have two children together. I hate to see my child exposed to this type of environment.
It has been about four years since the initial custody case. We have Joint custody, and he lives with his mother. I have visitation on the weekends. Me and the mother have gotten along good, and been able to communicate visitation.
When my son gets dropped off by his mother, he is often wearing dirty clothes, and sometimes and even have the smell of urine.
I have a full time job, with flexible hours. If needed I could even work from home when needed. I know I could provide more attention to my son, and offer him a more secure environment.
What are my chances of gaining custody?

Depends on a lot of things. Age and gender of the child, your living arrangements, hers, wishes of the children if they're old enough. The trouble is, the court will most likely appoint an attorney or a Guardian ad Litem for the child to make a report to the court. That's a $3000 or so bill that somebody has to pay.
