My divorce was final on 04/28/2008, we have two children and their father and I share 50/50 custody. In June of 2009, I plan on moving in with my Fianc� , however my ex-husband states that he will not allow the kids to move with me. The move is in the same town and my Fianc� has no record or any thing along those types of issues, he is regular hard working, bill paying man. Our custody arrangement would not change, nor would their school. Can my ex prevent me from moving? Or reduce my custody/visitation if I do move?

It's very unlikely that a court would prevent you. Typically, it's when you want to move to a different state that there's a problem. If they're staying in the same school, I don't believe a court would interfere. It sounds to me as though the ex doesn't like the idea of a fiance.

Assuming that the father's parenting time with the children remains the same, their school does not change, and there are no "issues" regarding your fiance, then you should go ahead with your plans. If he takes you back to court, he will have the burden to prove why the move is not in the best interests of the children.
