Legal Question in Family Law in Connecticut

he hid an illigitimate child

I was married 21 years and during that time my husband had an illigitimate child conceived during our marriage. For ten years he paid child support ($78,000) unbeknownst to me. Since we were both employed, am I entitled to half of that money now that we are divorced?

Re: he hid an illigitimate child

I doubt it, unless the divorce decree says otherwise. Did you ask this question to the attorney who represented you,as that attorney would be in the best position to answer you question. Normally, you are expected to know the financial situation during the course of your marriage and the information should have been provided in discovery while your divorse was pending. I don't know what was disclosed during the divorce or why you did not know $78,000 +/- was missing from your family income. Check with the attorney who handled your divorce. Usually, any agreement as to the division of assets cannot be contested, except by appeal in a very short time after the divorce. There may be fraud involved or other things that would allow a re-opening of the judgement, but your question is one that you should have a face to face meeting with your attorney who represented you in the divorce or another attorney. Sorry I can't be more helpful, but I is a complicated issue that should have be resolved at the your divorce, if it was not. It could have been considered with all the other financal information that is exchanged. Tom Noonan
