Legal Question in Family Law in Connecticut

income after divorce

If my divorce decree says, award 1.00 to my ex, does that mean I can never get a better job, without having to pay alimony to her.

Re: income after divorce

You can get a "better job" however, because the door is open to alimony she can go back to court and attempt to modify upward.

It is not clear what the intention was at the time the alimony terms were agreed to. If there were discussions that the purpose of the clause was to protect her in the event she lost her job or was unable to work because of illness, then this argument is a defense to her modification.

A court must look at not only your increase in income but her needs. If her needs have not changed substantially since the divorce, then regardless of your increase in income, she may not be entitled to a modification.

Generally, the $1.00 a year clause is to protect a spouse in the event of a catashophic event, such as illness, loss of job, etc. However, there are not guarantees.
