Can I leave the family home with my children?

My husband and I do not get along and life in my home has become very turbulent to say the least for me and my children. I need to know if I can acquire a new residence during the pending divorce.

Sure, you can leave. He may try to get temporary custody of the children, but that's unlikely. I wouldn't give him advance warning, though. He's liable to run to court to keep the children with him. Much easier if you move out with the children and then let him know. Try for the same school district, so the kids aren't moved to a new school. If you can't, the kids will most likely be allowed to finish out the year, but might have to move next year.
