If i file will my husband have to start paying as if we are divorced? He has been giving $ to an ex-wife with no kid's with her, claims he owes herand also seeing a co-worker in the military, he is also, he refuses to give me half our tax return,he gave me a little and acts as if i should be grateful, he took all of the refund as soon as it was direct deposited and he is arrogant. Also i had an appt. to get our car fixed, there is something broken on it that can be dangerous if not replaced, now he refuses to give me the money to fix it, i want to file something, i need the $ for a retainer for a lawyer. He acts like i have no rights.

A spouse must pay money to the other spouse in a legal separation or a pending divorce if the payee spouse obtains a court order forcing that person to pay a certain amount. Otherwise, generally, a spouse has no obligation to give the other person any money. (there are some exceptions)
