If a married couple has separated (living apart) but one of the party's is refusing to sign the legal separation agreement can the other party move forward legally without ramifications?

It's not clear to me if you actually mean a "legal separation" or one of you filed for a divorce. Sometimes people use the terms interchangeably.

Nevertheless, if your spouse will not "settle" the legal separation or the divorce and enter into an agreement, then you would have to move forward with a trial. You most likely will succeed on the basis of irretrievable breakdown.
