Q. What can I do?

A. Before any divorce action an individual should take inventory. That means obtain and have a minimum of 3 years tax returns, statements for all bank accounts, stock accounts and assets, statements for all credit cards, and any other liability. You should also start to track your monthly expenses. This will be needed for your net worth statement.

Q. Where can I file for divorce?

A. If you are living in New York for over a year you may file in New York - even if the husband moved out of state.

Q. Since we dont know where he is, how can we serve him the divorce?

A. The obvious answer is that you have to find him - or attempt to find him. This is usually done through friends and family. It is hard for a person to totally disappear. You may have to hire a private investigator to locate your husband. Assuming that you have taken all of the above steps and you still cannot locate your husband, you would have to ask permission from the Court to serve your husband by publication.

To provide information regarding the filing of divorce I will need more information however, one thing you can do is to file a petition for custody in the family court of the county you live in. That will permit you at least to have established ny as the court that will handle the custody. The custody case can be consolidated with the divorce case when you file. You could also file a petition for child support. Regarding service there are ways to effectuate service for persons whose whereabouts are unknown.
