Naming The Father

I'm 20 soon too be 21 and the father of my child is in jail. He is a really Mean and abusive. And the state (wellfare) says thet I have to name the father or I won't get any money. (i cannot work b/c i'm disabled) I don't want this person to have anything to do with my child. If I say he is the father what legal rights will he have over MY son?

This appears to be a question as to who is responsible for welfare benefits vs. parental rights. Welfare is not a grant, it is a loan that should be paid back. Your question should not be what is the father resposible for paying but what you and he are resposible for paying. If you refuse to name the father of the child, there could be serious ramifications, like you will be held resposible for all benefits received for medicals before birth and after plus support until the child is 18, or if in school until 19 yrs. Termination of parental rights will releave the father of payment for child support when the decree of termination is granted by the Probate Court that has juristicition, usually where the legal residence of You and the child is located. However, there are inheridance rights that will still exist and the debt to the state may have to be paid by you, if the state take action against you for fraud in not disclosing the father or for violiation of the laws and regulations which entitled you to collect welfare and medical benifits. It is not a simple answer and needs personal advice to get the facts and respond in more detail. This is just a brief answer of the question as there are many regulations, both state and federal, that apply to your fact pattern.
