Opening an individual account without consulting spouse.

I have been married for 16 years and discovered recently that my husband opened an individual account with money that his mother gave to him. The problem is that he used the money we had in our jt account to pay down our mortgage and left us with little cash. The only cash we have now is the money he has in his individual account which is has sole control over and can do whatever he wants with. Is this legal? Do I have a legal right to have him put the money into a joint account or at least reverse his action that left us without any cash? A decision done without consulting me?

Unfortunately, you have no remedy unless you try to divorce him and make a claim for the money. Spouses can pretty much do what they want without consulting the other spouse. They can hide money, spend money, gift it away....you name it, they can do it. And of course this includes you!

So, with that being said, I hope all of you spouses out there pay attention to the finances in your marriage. I see too many people who don't know what's going on in their marriage when it comes to money. They don't know what their spouse earns, they don't know how much is in their spouse's retirement account, or how much their spouse spends on credit cards. It's your money too so you better educate yourself if you don't know what's happening!
