Parental rights

My daughters father (we were never married) was ordered to pay child support 3 years ago and gave false personal information to the court and we have not heard from him since that day. I have Sole custody and want to know, how do I find out if he still has parental rights or if they have been terminated? I am now married and want to give my daughter my married last name. Can I do this if he still has parental rights?

Only you could move to terminate his parental rights, and it's a very difficult process. Obviously, unless you petitioned for termination, it has not happened.

You state that you have sole custody. Is there a court order that gives you custody, since you only mentioned the child support order.

If there is a case in superior court in which an order of sole custody was entered, you might be able to file a petition to change name in that case, or in the alternative, you could file a petition to change your child's name in the probate court in the town where you live.

You may be successful even though his rights have not been terminated, especially if there is a court order giving you sole custody. If not, you can still file a new petition in the superior court to change your child's name or in the probate court as I stated.
