Legal Question in Family Law in Connecticut
Phyiscal Custody and child support
I am a father who was just rewarded physical custody in coourt Dec 23. The biological mom agreed to me and my wife having him mon thru Friday with 2 weekends a month. During the court sesion none of us had finacial paper work done. I was asked if I wanted child support and said yes. the judge continued our case for Febuary to determine child support.
the judge realy seem to point the finger at my ex the mother has needing to provide child support. From the research done I believe the custodial parent is always awarded child support. do you know if this is true? The mother has been paying me cash from what is being deducted out of my paycheck becuase the wage ganishments are in the process of being stopped per court order unitll the next court date to determine support oblegator.

Generally the custodial parent is entitled to some support,
so in most instances the parent with custody will receive money however it is the amount that is up in the air

Yes, usually the custodial parent is entitled to child support from the noncustodial parent. You both will need to fill out financial affidavits (you can get the form at the clerk's office or online at the CT Judical Website).
The amount of child support is determined by the child support guidelines and based upon the combined net weekly income of both parents.
Make sure that the paperwork to terminate the wage garnishment is filled out and signed by the court, and then forwarded to your employer. You need not go to court for this. The clerk's office will handle it.
