my friends husband is very ill.he insists his brother is entitled to half his estate.is this true or would she be the only benificiary?they own a small home.

First of all, is the house in joint names? If so, wife gets all on his death.
If it's in his name alone, if he has no will, and there are no living children and no parents alive, it all goes to her. If there are parents alive, but no children, wife gets the first $100,000 plus 3/4 of the rest. If there are no parents, but children, all of whom are wife's and husband's, wife gets first $100,000 plus 1/2 of the rest. If there are children, some or all of whom are husband's but not wife's, then wife gets 1/2. The brother doesnt come into it at all, unless he has a will which leaves some of it to him.
