ReMarried Father Suing for Custody

My husband and I want to sue for custody of his 12 1/2 year old son. He has been diagnosed with Asperger's Syndrome, and he doing horribly in school. He skips school and doesn't get homework and assignments done. I help him with his work when he comes to our house every other weekend, but his mother is not on top of the situation. We have consulted with a couple of attorneys, but we can't afford the huge retainer ($5000-$7500) and my husband wants to sue without a lawyer. Can you please give me any advice on how to proceed. We are so afraid for his son. We feel we are losing him. He lies, steals, and just doesn't want to do any schoolwork. We feel we can give him the stability, structure and discipline that she can't. PLEASE HELP!!!!!

You begin the process by filing a motion for custody with the court. The clerk and or family services can then guide you through the process.
