sale of home after divorce and remarriage

Hi, I remarried 2 1/2 years ago after divorcing my first husband (father of my 2 kids). My ex just served me for contempt for not selling the house immediately. I honestly did not realize that I was supposed to sell upon remarriage, or I would have. The house is on the market now. According to the court order, my ex is requesting that I be incarcerated. Isn't this a civil matter? Can he do that? Also my hearing is tomorrow and I don't have a lawyer - can't afford it now and don't see that improving any time soon. I'm 51 years young and I've never been arrested and I don't want to jail. Thanks.

The court has the discretion to order jail in a contempt motion. However, it is unlikely. In addition, the court may order you to pay the other parties attorney fees as well. If you need help, you can email me at [email protected].
