same sex break up
My partner and I of 8.5 yrs are breaking up. We have a townhouse (it doesnt have my name on it nor the car which is paid off) I have money in savings that I am holding hostage until she agrees to put my name on those items. Does she have any recourse to this money? As it stands, I only have the house with my name on it. All of these assets were acquired during our relationship. Is it possible for me to keep the money and let the townhouse and car go to her so we can stop the fighting. I am willing to walk away with just the money and any proceeds I get from the sale of the house. I also can not afford to pay 50 percent of the mortgage but I am currently residing in the house. Do I have too? She makes 3 times as much as I did and I am currently unemployed. I was laid off in Jan 07, which she was perfectly aware was going to happen.

Unmarried partners are able to enter agreements relating to the division of property. Such contracts may be express and implied and, subject to appropriate proof, are enforceable in court. Also, with respect to the mortgage--you may enter an agreement with your partner on payment, however, if your name is on it you will nonetheless be held responsible for it.

Since this isn't a marriage, you will have to determine rights and liabilities according to contract law. However, there are other issues involving other areas of law as well. Simply put, you need to provide more information in order to to receive a complete opinion.
