Single mother has Custody question

I am a 23yr. old single mother of a 5 yr. old. I am pregnant, but not by the father of my first child. The father of my new child has decided that he would like sole custody, and does not want me to have visitation(he is 22). I do plan on fighting this in court when the time comes, but I am wondering if there is much of a chance of him winning? I have offered him every weekend & 1 night per week...but he simply will not budge. What should I do? Will a judge favor him because he does not have children & is better off financially?

A court will not give him sole custody unless he can show that you are an unfit mother. This is a heavy burden to prove and is probably unlikely unless you are a drug addict, alcoholic or grossly neglecting or abusing your children.

However, a court may grant him joint custody, with you as the primary residential custodian. He probably will not be successful proving that he is the better primary residential custodian since your baby will be a newborn and he has had no experience raising a baby from birth.

Finally, the financial factor will probably not have much weight when it comes to custody in this particular situation. It will be a factor in how much child support he has to pay you.
