Sole parental custody

I was granted sole parental custody to my 9 yr old daughter and have a protection order in effect on top of the divorce proceedings, he has no legal rights to the child at all except to pay childsupport. He is not to have any contact or anything. If i was to die would she go to him? Also since he has no rights at all by the court, can i have his rights permentaly taken away by him giving up his parental rights?

The child would not automaticaly go to him. The child would be placed with its best interest. He may have a valid claim to custody should you pass away. Is the protective order for you or for the child? As to a surrendering of parental rights, this is typically a voluntary procedure unless the court determines that he is a threat to the child's well being.
