Terminating Parental Rights

My fiancee' has been put in jail with a criminal restraining order against him to forbid him from seeing his kids. He wants me to help him find info. on how to terminate his parental rights, since he has none now anyway. How can he terminate his parental rights? What can I do to help. (he has given me Power of Attorney, if that matters)

The mother of your fiancee's children would have to agree to the termination of his rights. However, that still does not mean that a court would accept the agreement since the state has an interest in requiring parents to support their children. Incarceration may not be a defense to his duty to support them. More information is needed to advise you. Your fiancee should hire an attorney to advise him on his chances of success.Although you have a "power of attorney," a court would require him to be present at any termination hearings. The Department of Corrections can transport an inmate to court when needed.
