Legal Question in Family Law in Connecticut

Tired of having to pay for everything

My son has a 7 year old son from a one night stand some time ago (before we met). He has to pay the mother $530 a month and pay 100% of all visitation costs because we live out of state and are active duty military...he was when she got pregnant and she knew it. She actually took him out of Alaska long before my husband's tour of duty was over. because airlines changed rules on unaccompanied minors, he can only fly on non-stop flights and has to fly out NYC (110 miles from her home in CT) and we have to pick him up in Phoenix, (100 miles from our home), the judge ordered us to pay for EVERYTHING and pay her $100 each way when she has to drive him to NY, even though we pretty much have to drive the same distance. We can't afford this anymore. He has had him almost 50% of the year since he was two, though that stopped in kindergarten because of school so we just have him summers and holidays. My husband is going to write his son's mother and the judge and tell them that he cannot afford to have his son visit if the mother doesn't split the air fare costs. We really want to see him, but SERIOUSLY can't afford it, we have three other kids. Is this custodial/visitation suicide? What do you think a judge would do?

Re: Tired of having to pay for everything

The judge will do what is fair to both parties. If you are experiencing serious financial difficulty and cannot continue with the present arrangement, the court will consider this as a factor. While a change is not guaranteed, the most important point is that you have the ability to petition the court for a change of support. You will have to prove to the court that you are experiencing a major financial struggle with the current order.
