Legal Question in Family Law in Connecticut

Unmarried with child - want to move out of state

I have a young child and am living with, but not married to, his father right now. I am considering moving out of state with our child where I can find a better job and life for myself and my son. Can I do this legally?

So long as there is no court order in effect preventing you from removing the child from the state, you are free to leave and take the child with you. However, the father will have 6 months during which he can go to a CONNECTICUT court to seek an order that the child be returned to Connecticut. The court might not issue such an order, but for 6 months it would be a Connecticut court, not a court in the state to which you moved, that would get to decide.
