Visitation
I'm a 45 year old father, disabled with a mycocardiomyopathy heart condition, waiting for a heart transplant. I have two small children ages 3and 6 that live in Ct. with their mother. Currently I have to see them under supervision only for an hour because my Ex-wife told the judge she believed I would flee with them either to Florida or to Portugal. Its my word against hers.I cannot travel 1400 miles to Ct, just to see them for one hour.
I want to have them here with me in Florida for their vacations, and when I visit them on their birthdays, or holidays,or simply visits, I want to take them to a movie,eat a pizza,play in a park,etc. Why can't we stay together in the hotel for the weekend????
My condition is being ignored by her as well as by the system. Can you Help??????

As a parent desiring to enjoy expanded visitation with your young children and also suffering serious health problems, you pose a serious question. Based on the information provided, it appears that, as a legal matter, you can petition the court to modify the present visitation order, or seek temporary visitation arrangements because of your medical issues. However, as a practical matter, the distance between your residence and the residence of the children, the tender age of the children, your health problems, and, perhaps, other factors weigh heavily against your obtaining extended visitation with your children apart from the other parent. You are advised to consult with an attorney regarding legal alternatives available to you after a review of the Final Judgment and other orders, and the development of a plan of visitation which may have greater probability of court approval.
