Legal Question in Family Law in Connecticut

For two years since divorce there has been a shared custody agreement in ct, where the child spends near 50/50 time at each house and the parents split every cost (school, health, social etc); can the mom go to court and receive money from the dad? For two years of seperation, before divorce was granted, there was a 2 week on/2 week off agreement where again, all costs were shared.

Also to be noted, the dad is currently unemployed and a full time student - the mom makes approx $40-$50k per year. Will the courts ask for money from someone with no income when all costs and time are shared?

Thanks!

J

I would think that there has to be a "substantial change in circumstances" for the Mom to win a Motion to Modify the support provisions of the divorce. In your situation this means that something has changed- you make more money (not less), she makes less money, things are not working out with the shared custodial arrangement, and so on.
