Legal Question in Medical Leave in Connecticut

Callenging a health POA

My uncle 94 (I am the only next of kin) is in the hospital and confused. 4 years ago he met a woman (25 years younger and not a US citizen) and she ''charmed'' him. In 2005 he made a POA giving her the right to decide over his health.

I the nephew want to challenge this PAO now, because they had many fall outs in this relationship, long period of times like 8-12 month separation 2 or 3 time in this 4 year period. She cajoled him into buying a house with her in Europe and she did not put him on the deed. asked him for big sums of money. I have reason to suspect that she only used him, and that he forgot about this POA.

Can I challenge this and how do I go about it. How much would I have to invest. Please bear in mind that this woman now is staying in his house and using his car while he is in the hospital.

Re: Callenging a health POA

I read your question with interest because my law firm had litigated a similar issue recently. It would be necessary for me to speak to you to get the exact details of why your uncle was mentally unstable at the time the power of attorney was signed. I have an associate who has practiced in your area of New York City for the past 15 years. I would suggest that you e-mail me your phone numbers (both home and cell) so I can speak with you tomorrow to discuss this further.

Sincerely,

Robert Roemer
