Legal Question in Federal Tort Claims in Connecticut

negligence and informed consent

1. VA general counsel has elected to reopen my FTCA dealing with negligence secondary to foot surgery that left me with drop foot. Three medical profess. has stated the palsy is related to casting. i have a congenital defect on my opposing leg--born without hip socket. so the foot surgery has left me limping on two legs, using four pronged cane.

2. same case-the informed consent process as per VA regs was ignored and the DPM fraudulently documented I was informed of risks et al. prior to surgery the operating resident brought the consent form for sig. this also contained information absent from my medical record. i have jacho investigating them for fraud and absence documentat. in medical record. results investig. due 9/9/07.

i wonder if i should accept FTCA settlement (if reasonable) and what is the ceiling on dollar amounts?

do these sound like cases to take to fed court?
