Court Ordered withdrawal trust account

My daughter has a Court ordered withdrawal savings account with Jackson Federal savings & Loan since 1986. My daughter has the right to claim the money when she turns 18 yrs. old. She tried to claim the account, but the bank said it did not exist. I took a copy of the case to the bank & they said they would search & call me. I called back (1) mo. later. They said they do not have to provide any info to me. My daughter now in the Military, Germany, called them & they claim to have the money but said she needs a court order for withdrawal. How can she do this when shes in Germany & the case was held in Riverside? & How much will it cost?

The bank should release the money without further order of the court. Most of the current such court orders (forms) state this. I would be happy to take a look at this matter for you. If your daughter cannot afford to hire an attorney, she may seek help from the Judge Advocate General's corps. These are military lawyers who help military personnel deal with legal problems. (They also do other things, of course.) This should not be a complicated problem.

Thanks for your inquiry. You didn't mention what type of account was set up for your daughter, other than it was a "court ordered withdrawal savings account". Perhaps this was proceeds from a minor's personal injury case or a probate matter? At any rate, what you need is to bring a motion before the court, with a declaration that she is above the age of 18, and attach an order for the judge to sign.

I have an office in Riverside, and I'd be happy to handle everything for a low fee. Even though your daughter's in Germany, only her signature on a declaration is required, which we can do through the mail or via international courier.
