Can I sue someone for theft. I ''friend'' of my daughters tricked us into letting her into our home where she stole $30,000 worth of jewerly. She made up a story about work being done in her home which her mother told the police was not true. Its a long story. Everyone including the police believe she is guilty, but there is no evidence. I don't think she should get away with this. Can a file a civil suit?

Yes you can. You can sue her for civil theft. The statute allows for treble damages. (three times the amount of damages-in your case- $90,000.00)
The standard of proof in a civil case is less than in a criminal case. Therefore, just because there may have not been enough evidence to prosecute her in the criminal matter, there may be enough to prove the civil case.
