Legal Question in Civil Litigation in Connecticut

Gift

My daughter's boyfriend bought her a car for Christmas. In mid March, she ended the relationship, he wants the car back or $3000, I don't think he is entitled to anything, however he has the title and keeps telling her if she doesnt give him the car or the money he is going to take it. Can he do this and is this legal? The car is registered in my name and it is also on my insurance policy. Please advise. Thank you.

Re: Gift

Whose name is on the title?

Nevertheless, I do believe if the car is registered in your name and is on your policy, he can not take it legally. Another words, you may be able to report it stolen if he takes it. However, the local police department will probably say it's a "civil matter," and tell you to seek relief through the courts. (This is a guess on my part, so you will have to see what happens if he does take it)

If the title is in his name only, then you would have to sue him to obtain title. It's a gift and the fact that he gave it to her for Christmas, she has possession and use, and you registered it in your name and put it on your insurance, is proof that the title should be turned over to your daughter. If the value is under $5000.00 you can sue him in small claims court.
