The condo would be part of the marital estate. Let's put it this way, the condo is not exempt from consideration. A judge would probably do what seemed fair under all the circumstances.

Any assets acquired during the marriage are subject to distribution. Thus, if you inherited a condo during the marriage it may be subject to distribution in the event of a divorce.
