how long to keep a deposit

My boyfriend is selling his car. A gentleman came and put a deposit of $500 down, and said that he would contact us in two days to come and pick it up and pay us the rest of the money owed. It has been almost two months and still no contact from him. Now we have another man who wants to purchase the car. Can we keep the deposit since the guy has not made the attempt to come and get the car. And can we sell it to this other man?
