Legal Question in Civil Litigation in Connecticut
Medical boards unlawfully suspended license
The medical board summarily suspended a physician's license without any evidence & finding of negligence. There was no due process or compliance meeting. The Board took one year in the hearings. The physician was exonerated in October,97. In November 97, board voted to continue suspension until memorandum of decision is prepared. Then the Board ordered the physician undergo psychiatric counselling once a month for three years for "? adjustment disorder" due to the stress of the hearings. The examining psychiatrist wrote:"the case is in the wrong forum & license be given back without any consent decree".
"False affidavits under oath" for negligence were prepared by public health department and signed by
physicians. This was proved in hearings. No peer review process in the hospital. The patients did not have any knowledge. No documents for negligence exist in hospital files. Actully hospital administration retaliated for filing charges against the chairman of department for
falsifying minutes of departmental meetings.
What legal avenues for loss of livelihood, false charges in the data bank, even though license was
reissued. Cannot get malpractice insurance, contracts and employment.

There may be help
Some physicians claiming facts such as those postulated have been successful in obtaining large settlements and other remedies to the problems you set forth.
Although I do a substantial amount of contingent work, I have always (as I expect other attorneys do) required a substantial retainer, probably in the neighborhood of $5000, to cover costs and fees for the initial investigation. Initial consult free.

All these things, of course, are actionable and
compensable in court if you can prove them. The
question is, do you have the stomach, evidence,
and resources to take on the government?
