Small Clains

8 months ago, I damaged my friend's car. She paid $500 for the deductible. At first, my friend would not tell me how much I had to pay. She was waiting because she thought she may not have to pay the full amount. I moved out of state a few months later, now she is threatening to sue me. She says that not only will she sue for the $500 but for lawyer fees as well. Can she sue me for her lawyer fees? Is this considered a small claims case? Can I be sued if I no longer live in the state? Any information would be greatly appreciated.

It's a small claims case if she sues you in small claims court. She can only sue you for attorney fees if it's available by statute or contract. I'm not so sure this is one of those cases, and although I doubt she will be successful on the attorney's fees, I would need more information about what kind of lawsuit she intends to file.

Yes, she can sue you if you live out of state.

Small claims.

You can be sued even if you are out of state.

Almost certainly, attorneys fees are not available.

If you damaged the car, then offer to pay her $500. Get a release.
