Legal Question in Immigration Law in Connecticut

Expired Visitors Visa

My girlfriend is a 49 year old woman from Ecuador. She came to the United States about 3 years ago on a 90 day visitors visa. Obviously her visa has expired and she has stayed illegally. What options are available for her to stay in the United States and work here. I cannot marry her but I could sponsor her if that is an option.

It is an option only if she qualifies for a labor certification= she posses a special skill that there are no qualified persons in the U.S., ect.

Your girlfriend is out of status and subject to arrest and deportation as an overstay. Under the new law, overstays may be assessed daily fines. Further, ajudication procedures under the new law have been dramatically expedited. If your girlfriend can qualify for some form of employment based visa it will still be necessary for her to depart the U.S. and return via normal overseas processing because she is out of status and there appears no extenuating circumstances for her overstay other than she didn't want to go back home. If her intention is to reside permanently in the U.S. she is precluded from any sort of non immigrant visa. I would suggest you contact an Immigration lawyer in your area because your girlfriend needs legal assistance.
