Legal Question in Immigration Law in Connecticut
I140 approved - Getting married to US citizen
My I140 petition has just been approved, my company will now apply for I485. I will get married to a US citizen in 2 weeks. What should I do? Apply for the I485 with my company or get my green card on my own based on the marriage. Thank you.

It would be faster through marriage as you'd likely get your green card in about 6 months.

Our advice would depend on a number of factors: namely, your priority date, your country of chargeability, your employment preference classification (EB-2 v. EB-3).

You may want to discuss the details of your situation with an immigration attorney before deciding. The marriage based petition will typically be faster, but if your employer is paying for the I-485 and your priority date is current you may opt to continue on with that route. Every so often an employer is willing to pay for the marriage based petition, as it is typically cheaper and faster than the employment based route.
