Hello,I entered on a Q1 visa and overstayed for 3 years.I am now married to a USC and would like to know if I will have to go back to my country.I also was granted a B2 extension change of status after that. while my B2 was still valid I applied for the green card.

Re: Q1 Overstay
Hello. You do not have to go back to your country. It isn't clear from your message how much time you have out of status. If it is more than 6 months, then it is very important that you not depart the United States until you adjust status to permanent resident. Of course it is in your best interest to be represented throughout the process to avoid potential pitfalls or at the very least have a consultation with an experienced immigration lawyer. Please feel free to contact me if you would like a consultation.
