Should we accept the first offer from a Title Insurance Company?

We submitted a claim to our title insurance company upon discovering a 30ft easement cutting our back yard in half. The insurance company researched and agreed that there was a claim. An appraisal was done on our property. The results were that we were at a loss of $8000 (in damages). I'm not sure that we should accept the offer or pursue this with an attorney. The only reason we are asking, is that our septic system is located directly within the easement. Should we have to replace the system, we will need a tremendous amount of fill and an engineered system to stay within the health department guidelines. I don't believe the $8000 will cover that cost. Should we pursue this issue?

Immediately retain your own expert/contractor, advisor who can tell you exactly what you will have to do, now and in the future, regarding this matter. If the $8k is right, no problem. But if your hunch is right, then you need legal assistance. Do not wait, and do not tell the insurer what anything yet. Keep all communications to letter form. Contacting an attorney will make your life and claim easier.

Make sure you get a lawyer who does NOT work for insurance companies - but who does know about insurance matters and title insurance claims.
