Legal Question in Insurance Law in Connecticut

My auto insurance company will not pay

I expirienced a car fire and my auto insurance company won't pay. I had full coverage on the car at the time, and just renewed my policy. I made claim several months earlier and the say the wrote the car off as salvage. They never told me that they did this and I just renewed the policy for the book value of the car. What can I do?

Re: My auto insurance company will not pay

It's pretty clear that if the car had not been fixed,

you should not / would not have had to pay full price

for insurance after the accident and are due a refund.

But the big question is, why 'wouldn't' they pay after

the fire? Did they call it arson? Was that somehow

excluded, even if you hadn't been the one to start

the fire? What's going on with that? Just b/c an insurer

says they won't pay a claim doesn't mean they don't have

to pay it; they might only need to be forced into it under

threat of a lawsuit. (This state can give a plaintiff triple

damages plus attorneys fees when an insurer doesn't pay on a

reasonably clear claim.)

You should consult an attorney there.
