What if the other person didn't have car insurance?

My husband was recently in a car accident, and was not at fault. A lady rear-ended him, and claimed to have insurance. We later found out that she did not have any, and are now stuck paying for all of the damages. Is there anything we can do? What are are legal rights in a case like this?

First, you should make a claim under your own collision coverage. Or you might have uninsured motorist property damage coverage which will pay your deductible and the collision will pay the balance.

You can also check the registration on the defendant's car and see if someone else is responsible and then sue both of them. Was the lady acting for someone else, i.e., on a business errand or??? If so then the business is responsible.

Finally, just sue the lady in small claims court.
