Employer mandates flu shots, wants employees to waive liability.
My employer, a large not for profit hospital is mandating flu shots for all of it's employess or risk termination. The majority of employees would rather not get the flu shot but will simply not to lose their jobs, myself included. However, the employer is trying to make us sign a wiaver releasing them from any liablilty which may arise relative to receiving the flu vaccine. Is this legal? What are my rights?

Generally, it is not a good policy to sign anykind of waiver without having an attorney review it. If there is a problem with the flu vaccine and someone has a reaction, it is possilbe that the waiver may preclude certain rights one might have against the party administering or requireing the adminstering of the vaccine. That is one of the reasons why the waiver should be reviewed by an attorny.
As to whether or not you can be terminated for not getting the flu shot, alot depends on the terms and conditions of your employement [i.e. what kinds of waivers or agreements you may have entered into with your employer as condtion of getting your respective jobs] and alot depends on the reason why your employer might be mandating the flu vaccine.
It may be possilbe, if there is a legitimate reason for getting the flu vaccine to get it on your own or through the employer withou having to sign the waiver. I would have to know more to properly advise you.
