Eviction/Securuty Deposit

My 1 year lease expires on the 31st of this month. I gave my landlord one month's security deposit. I have never missed a rental payment and I pay on time every month. This month (which is my last month) I did not pay the rent. Now my landlord is trying to evict me, can he do so? Can't he use the one month's security deposit I gave him? And what should I do at this point seeing as how my lease is up in less then 10 days and I'm moving into my new apartment anyway?

I'm baffled that your landlord would try to evict you with one month left. It doesn't make any sense.

There is no reason why he can't just keep the security deposit. If you didn't notify him that he can keep the security deposit in lieu of the last months rent, then you should do so in writing immediately. You should send it regular mail and certified, return receipt.

I would just move and not worry about it. If you get a court date, go to the court hearing and explain everything. Bring all of your receipts to show you were on time with the rent and a copy of the letter.

I can't imagine what the landlord believes he can gain by this.
