what are landlord rights?

We verbally agreed to rent our recently acquired commercial property to someone who we now know is dishonest. We allowed him access and apparently this has given him the right to remain, even without a signed lease. It appears he is living there although it was rented as an office. He has a draft of the lease with a set rent and line items allowing him to install shower and kitchenette. (We were very trusting and believed the ''I want to bike to work'' and ''have a lunch area for employees'' lines, among other things.) Can I present him with a revised lease at a much higher rent and without these line items? If he refuses to sign/pay, can we evict? How? Does this require a lawyer/court? Thank you.

Without a signed lease, you can evict a tenant. This is because the tenant is considered a month to month tenant. At the end of the month, you can evict him. This process can be time consuming and is not immediate. If you need help, you can email me at [email protected].
