I have a years lease. several neighbors have complained to landlord my 5 year old runs around unwatched-untrue- last week-end a group of kids got into paint and spilled in all over my yard. Someone poured some on the neighbors driveway no other damage. the landlord has asked us to move . Does he have a legal complaint and can he throw us out

This would depend on whether your child was the one who spilled paint on the yard and neighboring driveway. It would also be helpful to know what grounds your landlord is claiming to evict you for. Generally, as a tenant you must keep the property and surrounding areas clean and in good condition. A landlord may evict a tenant on numerous grounds including: nonpayment of rent, violation of a term of the lease or of a tenant's duties and responsibilities, or nuisance or serious nuisance. Nuisance is conduct that substantially interferes with the comfort or safety of other tenants or other more serious conduct. Given the facts you have provided I would assume your landlord is attempting to evict you for nuisance, which he may have grounds for. In order to fully answer this question though, an attorney would need more facts and information about your lease agreement.
