I have a question regarding my landlord and what I need to do if he should sue me for breach of lease for my apartment. I am in financial distress and the landlord is aware of this. He asked me to give him a months notice to start showing my apartment, which I did. It has been almost one month and the apartment has not been rented out. My lease is up in Feb. and I do not have the money to pay for October. If he sues me I would like to know what to do.

Did he actually agree that you could break your lease? If he asked for a month's notice to start showing the apartment, he may be relieving you of the balance of the term of your lease. Unfortunately, this is a guess. However, if you continue to live there, then the question becomes is it now a month to month lease or a holdover. Finally, you may be liable for rent for as long as you stay there regardless of the lease.
If he sues you, I think at the least, you would be liable for the time you stay there and possibly the security deposit. I really don't think you will get out of this without a judgment because you do owe the money. Financial hardship is most likely not a defense.
